1. Acceptance of These Terms

By using our website, booking a service, or giving us your phone number, you agree to these Terms and Conditions. If you do not agree, please do not use the website or our services.

These terms apply to the website at whislerstudios.com and the services provided by Whisler Media, LLC, doing business as Whisler Studios ("Whisler Studios," "we," "us," or "our"). We are a real estate media company based in Washington, Iowa.

2. Our Services

Whisler Studios provides real estate media for agents, brokers, builders, and property owners. Our services include:

Real estate photography
Video
Drone (aerial) photography and video
3D tours
Floor plans
Property websites

Services can be ordered individually or as bundles through our online order pages. The services, pricing, and deliverables shown at the time of your order are what we agree to provide.

Aerial work is flown by an FAA Part 107 certified pilot. We may postpone or decline a drone flight because of weather, airspace restrictions, or safety concerns.

3. Booking, Scheduling, Cancellations, and Payment

An appointment is confirmed once we confirm it with you by website, email, or text message.

Property access and readiness. You are responsible for making sure our photographer can enter the property and that it is ready to be photographed (cleaned, staged, and lit as you want it to appear). We are not responsible for conditions we are not allowed to change.

Rescheduling and cancellation. Please give us at least 24 hours notice to reschedule or cancel. Changes or cancellations made with less notice may be charged a fee of 10% of service cost. We may reschedule an appointment because of weather or safety concerns at no charge to you.

Travel. A travel fee may apply to properties outside our standard service area. Any travel fee is shown before you confirm your order.

Payment. Payment is due at the time of booking / upon delivery / within 60 days of invoice. We accept credit card online payments. Payments are processed by third-party payment providers, and we do not store your full card number. Invoices unpaid after 60 days may be subject to a late fee of 10% and a hold on delivery of your media.

4. Delivery, Licensing, and Intellectual Property

We deliver finished media through an online gallery or download link, usually within 24 hours of your appointment. Please download your files promptly. We keep files for 12 months but are not required to store them indefinitely.

Ownership. Whisler Studios owns the copyright in all photos, video, aerial footage, 3D tours, floor plans, and websites we create.

Your license. Once your invoice is paid in full, you receive a non-exclusive license to use the media to market and sell or lease the property shown. This includes MLS listings, brokerage and agent websites, social media, email, and print marketing. The license extends to the listing brokerage, the property owner, and the MLS. You may not resell the media, license it to others for unrelated purposes, or edit it in a way that misrepresents the property.

Our use. We may use the media in our portfolio and promotional materials. If you would like a specific property or image left out, tell us in writing.

5. SMS Text Messaging Terms

By giving us your mobile number and opting in, you agree to receive text messages from Whisler Studios as described in this section.

Program description. Whisler Studios uses text messages to communicate with clients about their orders and appointments. These messages include appointment confirmations and reminders, scheduling changes, photographer arrival notices, delivery of completed media, invoice and payment notices, and replies to your questions. We do not send marketing or promotional text messages under this program.

How you opt in. You consent to receive texts when you (a) check the text message consent box on our website order form or contact form, (b) give us your mobile number to book or manage an appointment and agree to be contacted by text, or (c) send us a text message first. Consent to receive texts is not a condition of purchasing any service.

Message frequency. Message frequency varies based on your orders and appointments.

Costs. Whisler Studios does not charge for text messages. Message and data rates may apply according to your mobile carrier plan.

How to opt out. Reply STOP to any message at any time. We will send one final message confirming that you are unsubscribed, and you will receive no further texts from us. You can also ask us to stop by calling (319) 461-8382 or emailing hello@whislerstudios.com. To receive texts again, reply START or opt in again through our website.

Help. Reply HELP to any message, or contact us at (319) 461-8382 or hello@whislerstudios.com.

Carriers. Wireless carriers and Whisler Studios are not liable for delayed or undelivered messages. Text messaging is available only to mobile numbers in the United States.

Your mobile information. We do not sell, rent, or share your mobile phone number or your text message consent with third parties or affiliates for their marketing or promotional purposes. We share your number only with service providers, such as our messaging platform provider, as needed to deliver messages on our behalf. Sensitive information. Text messages are not a secure channel. Please do not send us payment card numbers, passwords, or other sensitive personal information by text.

Consent language for your website forms

Place this next to your order and contact forms, with the checkbox unchecked by default and the link text pointing to your Terms and Privacy Policy pages. Carriers look for this on the page they review.

6. Privacy and Your Information

Our Privacy Policy at https://www.whislerstudios.com/privacy explains what personal information we collect, how we use it, and the choices you have. It forms part of these terms.

In short, we collect the contact details, property addresses, and order information you give us so we can schedule and deliver your services, send you messages about your orders, and process payments. We do not sell your personal information, and we do not share your mobile number or text message consent with third parties for their marketing.

7. Website Use, Disclaimers, Governing Law, and Changes

Using the website. You agree to use our website only for lawful purposes and to give us accurate information when you order or contact us. You may not interfere with the site's operation, attempt to gain unauthorized access, or copy site content without our permission.

Disclaimers. We work to deliver high-quality media, but we provide our website and services "as is." Photos, video, and 3D tours reflect the property's condition and lighting at the time of the shoot. We are not responsible for delays caused by weather, property access, or events outside our control.

Limitation of liability. To the fullest extent allowed by law, Whisler Studios is not liable for indirect, incidental, or consequential damages arising from use of our website or services. Our total liability for any claim is limited to the amount you paid us for the service at issue.

Governing law. These terms are governed by the laws of the State of Iowa. Any dispute will be handled in the state or federal courts located in Iowa.

Changes to these terms. We may update these terms from time to time. The "last updated" date at the top of this page shows the current version, and continued use of our website or services after a change means you accept it.
